Hello everyone,

I just wanted to advise you all on this thread as I have gone through all these immigration forms (k1 and i485) by filing for my wife who I recently brought from the Dom. Rep.

While filing for her paper, I went through both RFE and Intent To Denial, all because of little things I thought insignificant at time of filing.

The first stumble we had was a RFE because of failure to include an Intent To Marry letter from my then fiancée as she was still in the Dom. Rep. and it was an inconvenience to get her to sign her letter to then get it sent over the USA as only original signed doc. are allowed. After reading some suggestions from people at some  online forums, I decided to send the application without her letter. Some of the comments I read went along this line: “if your fiancée  agrees to come to USA to stay with you for 90 days, its common sense that she has intent to marry you”. I fell for it and what a deception.  Here I learned that to USCIS officers, is only valid if you can proof it.

Then, we got an Intent To Denial letter after the long wait for results on her  i485 application.  After my fiancée was approved the k1 visa and before she came to the USA, the immigration Doctor from her country of origin gave her a CD with all Vaccination Supplement for her to bring with her. Apparently, she was supposed to turn that CD in to the immigration official upon arrival to USA, but she was not told to do so and she didn’t turn it in.  Assuming that the information within that CD had already been added to her immigration files,  when we filled out the form i693, we only included the Medical Examination and neglected to include neither Vaccination Supplement nor the CD. Again, I went online to get some information on what we should be included on this form and I read a few people saying that it was not necessary to include the CD, ensuring that we just had to bring it with us at the time of interview as the immigration officer could be asking for it. . . what a mistake! After waiting almost a year to see if she was going to be approved or not, we finally got that Intent to Denial Letter. On that letter they said that the form i693 was incomplete and that they couldn’t find any more information on her file, and that’s why they reached that decision. On that letter, they asked us to resend  this form to the local USCIS office with all information CURRENT(vaccination supplement and medical examination). We followed all instructions this time and even included the old CD, but only as supporting document. One week later, we received the letter from USCIS saying: ” Your Application for Permanent Resident and Adjust of Status Has Been Approved”. . .  how nice… but what a journey!!

I don’t know if including the CD along with the medical examination had made any difference, but if I had to do this stuff again, I ‘d definitely complete the form i693 all from scratch. In my opinion, when it comes to these forms, even when you think you got it all covered, chances are you are missing something. My final advice to anyone filing: Before sending too little info, consider sending too much.

Now a quick comment to answer another question I was asked before, if different fees are required for each of these forms I485, I756 and I131: Answer is no,  only one  fee is requires when filing all these forms together. I included all steps on how to file these forms and also included some links you are going to need, and best of all  it’s FREE. By reading through this material and following the instructions and tips,  you may save yourself the huge headaches of those RFEs and Intent to Denial letters.
